DMCA Policy
Apple Fries respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we have adopted the following policy concerning copyright infringement. We will respond expeditiously to claims of copyright infringement committed using the Apple Fries service or website (the "Site") that are reported to our Designated Copyright Agent, identified below.
If you are a copyright owner or an agent thereof and believe that any content hosted on the Apple Fries Site infringes upon your copyrights, please submit a notification pursuant to the DMCA by following the instructions below.
Filing a DMCA Takedown Notice
To file a DMCA takedown notice with Apple Fries, you must provide a written communication that includes substantially the following:
- Identification of the copyrighted work claimed to have been infringed: This means a description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing: This includes a description of the material that you claim is infringing and information sufficient to permit Apple Fries to locate the material (e.g., a specific URL where the material can be found on our Site).
- Information reasonably sufficient to permit Apple Fries to contact you: This must include your full legal name, mailing address, telephone number, and, if available, an email address.
- A statement that you have a good faith belief: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.
- An electronic or physical signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that is allegedly infringed.
Filing a DMCA Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may send Apple Fries a counter-notification. To file a DMCA counter-notification with Apple Fries, you must provide a written communication that includes substantially the following:
- Identification of the material that has been removed or to which access has been disabled: This should include the specific URL(s) where the material appeared before it was removed or disabled.
- A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your full legal name, address, and telephone number: Information sufficient to permit Apple Fries to contact you.
- A statement that you consent to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Apple Fries may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
- Your electronic or physical signature: A physical or electronic signature.
